Terms of Service — d.P. Studio NYC

Welcome to d.P. Studio NYC ("we," "us," "our"). These Terms of Service ("Terms") govern your use of dpstudionyc.com and d-p-studio-nyc.myshopify.com (the "Site") and any purchase you make from us. By using the Site or placing an order, you agree to these Terms.

This is a working draft and should be reviewed by an attorney before publishing — particularly the Limitation of Liability, Indemnification, and Governing Law sections, which carry real legal weight and vary in enforceability by state.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order on this Site. If you are under 18, you may use the Site only with the involvement of a parent or guardian.

2. Our Products

d.P. Studio NYC creates made-to-order custom fight apparel (fight kit) for boxing and Muay Thai, as well as select Ready-to-Ship pre-made styles. By placing a custom order, you understand and agree that:

  • Each piece is built to your specifications (size, fabric, color, customization) and is not a stock item.
  • Minor variations in color, texture, or finish may occur between what's shown on-screen and the finished product, due to the nature of custom fabrics, dye lots, and monitor display differences.
  • Sizing is your responsibility. We provide detailed sizing guidance on our Sizing page, and we're glad to help you choose — but you are responsible for providing accurate measurements and confirming your size before production begins.

3. The Design Process

Custom orders follow the process described on our Design Process page: you share your vision, we send sketches, we send an estimate along with a request for a 50% deposit, production begins once the deposit is received, we send photos for your final approval, we invoice the remaining 50% balance, and your piece ships or is ready for pickup.

  • Deposits are non-refundable and go toward your total.
  • Rush orders require full payment upfront rather than the standard 50/50 split.
  • Once you approve your final design photos, the design is considered confirmed. Changes requested after confirmation, or once production has started, may incur additional charges.

4. Pricing & Payment

  • Prices shown reflect the base garment and fabric. Final pricing may vary based on design complexity, customization, and embellishment — you will receive a confirmed estimate before production begins.
  • We accept Zelle, Visa, Mastercard, American Express, and Discover.
  • Bundle discounts, bulk order discounts, and rush/expedite surcharges are applied as described on our Pricing page at the time of your order.
  • All prices are listed in U.S. Dollars.

5. Shipping & Delivery

  • Ready-to-Ship items ship in 1–3 days.
  • Made-to-order items ship according to the speed tier selected at checkout: RUSH (3–7 days total), EXPEDITE (7–10 days total), or STANDARD (10–20 days total), covering design, production, and shipping combined.
  • Local pickup is available in the South Bronx, and drop-off delivery is available at Mendez, Victory, and Bout gyms.
  • Shipping timeframes are estimates, not guarantees. We are not responsible for delays caused by the shipping carrier once your order has left our hands.

6. Cancellations & Changes

  • Orders may be changed or cancelled only if production has not yet started. Once your design is confirmed and production has begun, cancellations are not accepted, and deposits are non-refundable.
  • To request a change or cancellation before production starts, contact info@dpstudionyc.com.

7. Returns, Exchanges & Refunds

  • Ready-to-Ship / non-custom purchases: returns accepted within 30 days of purchase. Items must be unworn, unwashed, and undamaged. Refunds are issued to the original payment method; return shipping is the customer's responsibility.
  • Custom orders are not eligible for return or exchange, given their made-to-order nature. If you're unhappy with a custom piece, contact us and we'll do our best to make it right.
  • Exchanges (non-custom items only) are accepted within 30 days; we'll provide a prepaid shipping label. No exchanges are accepted on damaged product.
  • Approved refunds are processed within 7–10 business days.

8. Repairs & Alterations

All orders include free repairs and alterations to ensure proper fit. Contact info@dpstudionyc.com to arrange a repair or alteration.

9. Intellectual Property

  • All original designs, templates, patterns, and creative work produced by d.P. Studio NYC remain our intellectual property, whether or not a given design is ultimately purchased.
  • If you submit a logo, image, text, or other artwork for us to incorporate into your custom piece, you represent that you own the rights to that material or have permission to use it, and you grant us permission to reproduce it solely for the purpose of fulfilling your order.
  • You may not reproduce, resell, or repurpose our designs, photography, or site content without written permission.

10. Text Message (SMS) Program Terms

If you opt in to text messages from d.P. Studio NYC:

  • You consent to receive marketing and transactional text messages (including order updates and cart reminders) sent using automated technology.
  • Consent is not a condition of purchase.
  • Message and data rates may apply; message frequency varies.
  • Reply STOP to opt out at any time, or HELP for assistance.
  • See our Privacy Policy for how we use and protect your phone number.

11. Prohibited Use

You agree not to use the Site to: violate any law; infringe on the intellectual property or rights of others; upload artwork you don't have rights to; attempt to gain unauthorized access to the Site or our systems; or interfere with the Site's normal operation.

12. Disclaimers

The Site and products are provided "as is." While we take care in construction and quality control, we do not guarantee that products will be free from any defect, or that the Site will be uninterrupted or error-free.

13. Limitation of Liability

To the fullest extent permitted by law, d.P. Studio NYC is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or your purchase, including but not limited to lost opportunity (such as a missed fight date) due to shipping delays outside our control. Our total liability for any claim related to an order is limited to the amount you paid for that order.

(This clause needs attorney review — enforceability and required carve-outs vary by state, and some limitations of liability are not enforceable for certain claims.)

14. Indemnification

You agree to indemnify and hold d.P. Studio NYC harmless from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the Site, including claims related to artwork or logos you submitted without proper rights.

15. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

(Whether to add a dispute-resolution/arbitration clause and/or class-action waiver is a significant legal decision with real trade-offs — that's a conversation to have directly with an attorney rather than something to default into.)

16. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
